1. Acceptance of Terms

By accessing or using the Sports Data Now LLC platform at app.sportsdatanow.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you ("User") and Sports Data Now LLC ("Company," "we," "us," or "our").

2. Description of Service

Sports Data Now LLC provides a sports data analytics platform that aggregates, displays, tracks, and analyzes sports statistics, scores, bet records, grading outcomes, and related data for informational and entertainment purposes. The Service may include dashboards, data visualizations, historical records, third-party data feeds, and integrations with third-party messaging platforms such as Discord, Telegram, or similar services to facilitate data collection from users.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

4.1 Registration

Some features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at info@sportsdatanow.com.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

5. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Scrape, crawl, or systematically extract data from the Service without our express written permission
• Reproduce, distribute, modify, create derivative works of, or commercially exploit any content from the Service without authorization
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Transmit any viruses, malware, or other harmful code through the Service
• Use the Service in any manner that could disable, overburden, or impair the Service's infrastructure
• Use automated tools or bots to access the Service without prior written consent
• Submit false, misleading, or fraudulent bet data or other information to the Service

6. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, data compilations, grading logic, analytics, and software—are the exclusive property of Sports Data Now LLC or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

7. Third-Party Platforms and Integrations

7.1 Third-Party Platform Access

The Service may integrate with or access third-party messaging and communication platforms, including but not limited to Discord, Telegram, and similar services ("Third-Party Platforms"), for the purpose of collecting bet data, picks, or related information that users submit or post on such platforms. By using the Service, you authorize Sports Data Now LLC to access and collect data you provide through any connected Third-Party Platform in accordance with these Terms and our Privacy Policy.

7.2 Third-Party Platform Terms

Your use of any Third-Party Platform is subject to that platform's own terms of service, privacy policy, and community guidelines. We are not responsible for the availability, content, or practices of any Third-Party Platform. We do not control and are not liable for any data loss, privacy breach, or other harm arising from your use of Third-Party Platforms.

7.3 Third-Party Data Sources

The Service may also incorporate sports data, statistics, and content sourced from third-party data providers. We make no representations or warranties regarding the accuracy, completeness, or timeliness of third-party data. We are not responsible for the content, reliability, or practices of any third-party data sources integrated within the Service.

8. Data Accuracy and User Responsibility

8.1 No Warranty of Accuracy

ALL DATA DISPLAYED ON THE SERVICE, INCLUDING BUT NOT LIMITED TO BET RECORDS, GRADING OUTCOMES, STATISTICS, SCORES, ODDS, AND ANALYTICS, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. SPORTS DATA NOW LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY DATA ON THE SERVICE.

8.2 User-Submitted Data

Much of the data tracked and displayed through the Service is entered or submitted by users themselves. We do not independently verify, audit, or guarantee the accuracy of any user-submitted data, including bet picks, wager amounts, odds, or outcomes. Users are solely responsible for the accuracy of the data they submit.

8.3 Grading Disclaimer

Bet grading provided through the Service is based on available data and automated or manual processes and may contain errors. Sports Data Now LLC expressly disclaims any liability for grading errors, incorrect outcomes, or data discrepancies. Graded results are provided for informational and record-keeping purposes only and should not be relied upon as authoritative or final.

8.4 No Liability for Data Reliance

SPORTS DATA NOW LLC SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, OR CLAIMS ARISING FROM A USER'S RELIANCE ON ANY DATA, GRADING, STATISTICS, OR ANALYTICS PROVIDED BY THE SERVICE. USERS ASSUME ALL RISK ASSOCIATED WITH USE OF OR RELIANCE ON SERVICE DATA.

9. User Data — Sharing and Downstream Use

9.1 User Responsibility for Data Sharing

Sports Data Now LLC is not responsible for how users choose to share, distribute, publish, or use data or reports generated by or exported from the Service. Any decision to share bet records, performance data, analytics, or any other Service-generated content with third parties — including on social media, messaging platforms, websites, or in any commercial context — is made solely at the user's own risk and discretion.

9.2 No Liability for Downstream Use

SPORTS DATA NOW LLC EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM, LOSS, LEGAL CLAIM, OR REPUTATIONAL DAMAGE ARISING FROM A USER'S SHARING, PUBLISHING, OR COMMERCIALIZATION OF DATA DERIVED FROM THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO: LOSSES RESULTING FROM THIRD PARTIES ACTING ON SHARED PICKS OR PERFORMANCE DATA; VIOLATIONS OF APPLICABLE LAWS BY USERS WHO COMMERCIALLY DISTRIBUTE SERVICE DATA; AND ANY DISPUTES BETWEEN USERS AND THIRD PARTIES RELATED TO SHARED CONTENT.

9.3 Prohibited Commercial Distribution

You may not sell, license, or commercially distribute data, reports, or analytics generated from the Service without the express prior written consent of the Company. Any such use without authorization is a violation of these Terms and may result in immediate account termination.

10. Sports Betting — Tracking Only Disclaimer

Sports Data Now LLC provides tools that allow users to log, track, and analyze their own sports wagers for personal record-keeping and informational purposes only. The Service is strictly a data tracking and analytics platform.

By using any betting-related features of the Service, you acknowledge and agree to the following:

• Sports Data Now LLC is NOT a sportsbook, gambling operator, betting exchange, or any form of licensed gaming entity.
• The Service does NOT facilitate, process, accept, or place any sports wagers or bets on your behalf. No money is wagered, held, or exchanged through the Service.
• All betting data entered into the Service is self-reported by the user and used solely for personal tracking and statistical analysis.
• You are solely responsible for ensuring that your participation in sports wagering complies with all applicable federal, state, and local laws and regulations in your jurisdiction.
• The Service does not provide gambling advice, betting tips, or recommendations intended to influence wagering decisions.
• Users located in jurisdictions where sports betting is prohibited or restricted are responsible for understanding and complying with local laws. Use of the Service's tracking features does not constitute authorization or encouragement to engage in any betting activity.

Sports Data Now LLC expressly disclaims any liability arising from a user's participation in sports wagering or gambling activity of any kind. 11. Payments and Refund Policy

11.1 Payment Processing

The Service may offer paid subscription plans or one-time purchases. All payments are processed securely through Stripe, a third-party payment processor. By providing your payment information, you authorize Sports Data Now LLC to charge the applicable fees to your payment method via Stripe. Sports Data Now LLC does not store your full credit card or banking details — all payment data is handled directly by Stripe in accordance with their Privacy Policy and PCI-DSS compliance standards.

11.2 All Sales Are Final

ALL PURCHASES MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE.

By completing a purchase, you acknowledge and agree that you are not entitled to a refund, credit, or exchange under any circumstances, except at the sole and absolute discretion of Sports Data Now LLC.

11.3 Discretionary Refunds

Sports Data Now LLC reserves the right, at its sole discretion, to issue refunds or credits on a case-by-case basis. The issuance of a refund in any one instance does not obligate Sports Data Now LLC to issue a refund in any future instance or to any other user. Refund requests may be submitted to info@sportsdatanow.com and will be reviewed at the discretion of Sports Data Now LLC. We are under no obligation to respond to or honor any refund request.

11.4 Subscription Cancellations

If you cancel a subscription, your access to paid features will continue through the end of the current billing period. Cancellation does not entitle you to a prorated refund for any unused portion of a billing cycle.

11.5 Chargebacks

Initiating a chargeback or payment dispute with your bank or card issuer without first contacting Sports Data Now LLC at info@sportsdatanow.com may result in immediate suspension or termination of your account. Sports Data Now LLC reserves the right to contest any chargeback and to pursue recovery of disputed amounts to the fullest extent permitted by law.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. SPORTS DATA NOW LLC DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT DATA WILL BE ACCURATE OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPORTS DATA NOW LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, YOUR RELIANCE ON ANY SERVICE DATA, OR YOUR SHARING OR DISTRIBUTION OF SERVICE-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID BY YOU TO SPORTS DATA NOW LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Sports Data Now LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your infringement of any third-party rights; (d) the accuracy or legality of any data you submit to the Service; or (e) your sharing, distribution, or commercialization of any data or content obtained from the Service.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Pennsylvania. You consent to personal jurisdiction in such courts.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
